TERMS AND CONDITIONS

These Terms and Conditions hereinafter referred to as the Terms are a legally binding agreement between you as a user and or customer hereinafter referred to as you and the website https://www.trivilita.lt hereinafter referred to as the Website.

The Website is owned by the private limited liability company Trivilita UAB registration number in the Republic of Lithuania 145840736 address Tilžės g. 227A Šiauliai LT 76200 hereinafter referred to as the Company or we.

You should read the Terms and the Data Protection Policy on the Website before using it. By logging in using or placing an order on the Website you agree that the Terms and the Data Protection Policy apply to you. Otherwise you should not log in to or use the Website.

We recommend printing a copy of these Terms.

2.1. By using this Website you agree

2.2. If you fail to provide accurate complete and up to date information we reserve the right to suspend or block your access to the Website.

  1. AVAILABILITY OF GOODS AND DELIVERY RESTRICTIONS

3.1. The Company offers furniture furniture parts and other goods available on the Website hereinafter referred to as the Goods to potential customers.

3.2. All orders are subject to availability. If delivery issues occur or supply is limited we will refund the amount you paid.

3.3. Goods offered on the Website can only be delivered within Lithuania. For delivery to another European Union member state please contact shop@trivilita.lt.

  1. ORDERS

4.1. You may purchase goods on the Website. To place an order you must follow the online purchasing procedure and click the required buttons. After doing so you will receive a message requesting confirmation of your order.

4.2. We reserve the right to remove any product from the Website at any time and to remove or modify any material or content. In exceptional cases we may refuse to fulfill an order after notifying you.

4.3. We are not liable to you or any third party for removal of any product content or for failure to fulfill an order after notification.

  1. PRICE AND PAYMENT

5.1. Prices are indicated on the Website except in cases of obvious error. We make every effort to ensure prices are correct however errors may occur. If we discover an error in the price of goods you ordered we will inform you as soon as possible and offer you the option to confirm the order at the corrected price or cancel it. If we cannot contact you the order will be considered cancelled and a full refund will be issued.

5.2. We are not obliged to deliver goods at an incorrect low price even if we have sent confirmation if the pricing error is obvious and you could reasonably have recognized it.

5.3. Prices on the Website include VAT but exclude delivery costs.

5.4. Prices may change at any time. Changes do not affect orders already confirmed.

5.5. After selecting goods they will be added to your shopping cart followed by order confirmation and payment. You must follow the purchasing process and provide or confirm required information.

5.6. You may use permitted payment methods specified on the Website. We use encryption to increase payment security. Upon receiving your order we will perform a preliminary check of your funds source.

5.7. Your payment source is verified by the issuing financial institution. If payment is not authorized we are not responsible for delays or failure to deliver and cannot complete your order.

After order confirmation the Customer pays invoices for purchased goods directly to suppliers via bank transfer or Paysera intermediary services.

  1. DELIVERY

6.1. Delivery cost is 70 euros.

6.2. Will we be able to help with carrying in and assembling the furniture?

6.2.1. The carrying in service costs 40 euros. If the carrying in service is not ordered you will need to carry the goods in yourself. You may also order the assembly service which costs 40 euros. We remove and dispose of the waste.

6.3. We use third party delivery services. Exact delivery times are provided by these parties. We may estimate delivery times at our discretion.

6.4. Delivery delays may occur due to customization unforeseen circumstances or delivery distance.

6.5. If we cannot deliver on time we will inform you and offer a new delivery date or cancellation with a full refund.

6.6. We do not initiate deliveries for orders placed on Saturdays Sundays or public holidays.

6.7. Delivery means final receipt of goods at the agreed address when you or an authorized person receives the goods and signs the delivery document.

6.8. One or two days before delivery the courier will contact you to arrange a suitable time.

6.9. If after 30 days from order readiness delivery cannot be completed due to reasons beyond our control we will treat the order as cancelled and refund all payments including delivery costs except additional costs arising from a non cheapest delivery method.

6.10. Any additional transport costs resulting from cancellation may be passed on to you.

6.11. Ownership of goods transfers to you once full payment is received either immediately or at delivery.

  1. RETURN POLICY

7.1. Return cost equals delivery cost unless you return goods yourself to our warehouse at Purienų g. 51A Šiauliai.

7.2. As a customer you have the right to cancel your order within 30 days without giving a reason.

7.3. The cancellation period expires 30 days from the day you or a third party receives the goods or the last item in case of multiple deliveries.

7.4. To exercise your right of cancellation you must contact us using the details on the Website.

7.5. To meet the cancellation deadline you must contact us before the period expires.

7.6. Upon cancellation we will refund all payments received within 14 days. Refunds are made using the same payment method. We may withhold the refund until goods are returned or proof of dispatch is provided.

7.7. You are responsible for any diminished value of goods resulting from handling beyond what is necessary to establish nature characteristics and functioning.

7.8. Cancellation rights apply only to goods returned in the same condition as received. No refund is issued if goods are used damaged or returned without original packaging and documents. Goods must be returned with the receipt.

7.9. If returns are made via third party delivery arranged by us you must contact us to arrange the return. Goods must be sent in original packaging.

7.10. After inspection we will inform you whether you are entitled to a full refund. Payment will be made within 14 days subject to receipt of goods or proof of dispatch.

7.11. All statutory consumer rights remain guaranteed.

  1. WARRANTIES

8.1. We provide warranties as required by applicable law.

8.2. Goods conform if they match the description are suitable for normal use and meet standards typical for similar goods.

  1. LIABILITY

9.1. Unless stated otherwise our liability is limited to the price of the goods sold.

9.2. Liability cannot be limited where prohibited by law.

9.3. We are not liable for loss of income profit sales business opportunities savings data or time where permitted by law.

9.4. These provisions do not affect your statutory consumer rights.

9.5. We do not guarantee the security or accuracy of information on the Website.

  1. INTELLECTUAL PROPERTY

10.1. All intellectual property rights in the Website content belong to the Company.

10.2. You may not use content without our explicit authorization. We allow use of the Website to copy information necessary for use and access to goods.

  1. MISCELLANEOUS

11.1. The Company is not responsible for failure or delay caused by events beyond our control including technical failures natural disasters embargoes riots government actions terrorism war technological changes or other force majeure events.

11.2. You must comply with all applicable import export and sanctions laws.

11.3. We may provide notices by sending them to you or posting on the Website. Website notices are effective upon posting and direct notices upon sending.

11.4. To send notices to us you must use available communication methods. Notices are deemed effective one business day after sending.

11.5. You may not assign transfer sublicense or delegate rights or obligations under these Terms.

11.6. If any provision is invalid the remaining provisions remain effective.

11.7. These Terms constitute the entire agreement between you and the Company.

11.8. We may amend the Terms. Amended Terms take effect upon notification.

11.9. Use of the Website and transactions are governed by the laws of the Republic of Lithuania.

11.10. Any disputes related to the Website or orders fall under exclusive jurisdiction of Lithuanian courts.

11.11. Nothing in these Terms affects your statutory consumer rights.

11.12. In accordance with EU Regulation 524 2013 you may resolve disputes via the online dispute resolution platform at https://ec.europa.eu/consumers/odr/.

11.13. The authority handling consumer disputes out of court is the State Consumer Rights Protection Authority Vilniaus g. 25 01402 Vilnius www.vvtat.lt.

11.14. Links to third party websites are provided for information only and we do not control their content.

11.15. For automatic provision of postal codes and addresses we use https://postit.lt/.
